It seems a tough road ahead for Cisco in this ensuing battle for the use of iPhone trademark. Gizmodo reckons that there is an escape route for Apple. A logo of Apple in front of their product makes it read as ‘Apple iPhone’. The name totally changes but we are not sure if this makes a legal loophole. On the other hand, trade mark specialist in Europe have found a loophole which could make Cisco to give away the iPhone trademark.
Lee Curtis from Pinsent Masons says that a person in Europe can lodge a revocation application against a trade mark registration if the trade mark has not been used for the past five years. This goes against Cisco which launched its iPhone line on 18th December 2006 under the name of Linksys. The only way which can save the revocation of trademark in Europe is to probe that there were plans to resume the use of this trademark three months before the filing of revocation application.
