<p>It’s game over for Psystar. The U.S. District Judge William Alsup has put a permanent injunction against Psystar banning them from selling unauthorized PCs loaded with Apple’s Mac OS X. The injunction basically blocks Psystar from what it was doing previously but sparred its Rebel EFI software because Psystar did not elaborate what Rebel EFI does.</p>
<p>Rebel EFI is a $50 application that allows few Intel powered PCs to run Apple’s Snow Leopard OS. </p>
<p>Psystar is banned from:</p>
<p>- Copying, selling, offering to sell, distributing or creating derivative works of Mac OS X without authorization from Apple.<br />
- Intentionally inducing, aiding, assisting, abetting or encouraging any other person or entity to infringe Apple&#8217;s copyrighted Mac OS X software.<br />
- Circumventing any technological measure that effectively controls access Mac OS X, including, but not limited to, the technological measure used by Apple to prevent unauthorized copying of Mac OS X on non-Apple computers.<br />
- Playing any part in a product intended to circumvent Apple&#8217;s methods for controlling Mac OS X, such as the methods used to prevent unauthorized copying of Mac OS X on non-Apple computers.<br />
- Doing anything to circumvent the rights held by Apple under the Copyright Act with respect to Mac OS X.</p>

<p>Contrary to what Psystar must have believed, they won’t be getting any respite from the Apple lawyers. Psystar <a href="http://www.techtickerblog.com/2009/05/27/psystar-files-for-bankruptcy/" target="_blank">filed</a> its bankruptcy under Chapter 11 that temporary shields a company from any ongoing lawsuits. However, the Southern District of Florida bankruptcy court has lifted the stay on the lawsuit with a small caveat. </p>
<p>Though Apple can continue with the lawsuit, they cannot ask for damage compensation charges unless and until approved by the bankruptcy court. In short, the approval happens only if the company is proved solvent, which in Psystar&#8217;s case won&#8217;t happen.</p>

<p>Trash your hopes for a <a href="http://www.techtickerblog.com/2009/05/07/psystar-can-bring-a-mac-os-x-netbook-in-the-market/" target="_blank">Mac OS X netbook</a> because Mac clone maker, Psystar has filed for bankruptcy. The documents were filed on May 21 in Florida and are seeking for Chapter 11 bankruptcy protection. While there is every reason to believe that they succumbed to Apple’s courtroom pressure, their filing reveals they are closing the business due to the weak economy. Apparently, they owe more than $88,000 to their lawyers in the Apple case, DHL to the tune of $13,000 and IRS almost $12,000. </p>
<p>There is a hearing on June 5 which will reveal all the Psystar’s creditors, possibly revealing few big names backing the guerilla outfit.</p>

Entangled in a legal battle with Apple? No problem. This is the attitude of gutsy Psystar who vaguely confirms about a Mac OS X netbook that won’t be <a href="http://www.techtickerblog.com/2009/05/05/is-this-an-apple-netbook-yes-but-pencil-drawn/" target="_blank">pencil drawn</a>. </p>
<p>In an <a href="http://www.zdnetasia.com/news/business/0,39044229,62053219,00.htm" target="_blank">interview</a>, Psystar’s CEO hinted that they will be launching a notebook “on the lines of a netbook” which I think says it all. </p>
<p>Apple’s recent comments indicate that they could launch a larger sized iPod Touch or iTablet but the want for a physical keyboard might compel a user to go for Psystar even if it&#8217;s against Apple’s policies. </p>
